In March 2023, the Copyright Office released guidance stating that, when AI “determines the expressive elements of its output, the generated material is not the product of human authorship.”

that means ->

if you use generative AI, you cannot claim copyright to the (derivative) work and you may also be infringing other copyright rights if the derivative work is based on unlicensed training data
